Sandy Tholen joined Caldwell Leslie in March 2004 after an extended stint as a federal district court law clerk and three years of contract work for the firm. Her experience is broad and wide-ranging, encompassing complex environmental land use disputes, products liability, labor and employment disputes, and entertainment and intellectual property issues. Her current projects include a partnership dispute between physicians, alleged wrongful termination in violation of public policy, digital piracy in the motion picture industry, underreporting of theater ticket sales, and an action for legal malpractice.

Ms. Tholen entered Loyola Law School in 1992 after a career in the education and health care industries. She was licensed as a registered nurse and pediatric nurse practitioner, and as legislative chairperson for a state nursing organization, she analyzed legislation, testified before State Senate and Assembly Committees, and drafted position statements. She has conducted a variety of workshops on legal issues affecting nurses and schools.

At Loyola, Ms. Tholen served as managing editor of the Loyola Law Review and was admitted to the Order of the Coif. Upon graduating from Loyola, she completed a judicial clerkship for the Honorable Ronald S.W. Lew of the United States District Court for the Central District of California. She returned to the federal courts in 1998 after practicing as a litigation associate for Gibson, Dunn & Crutcher in Orange County.


Representative Cases

 Prosecuted a series of digital piracy actions brought by the major motion picture studios against manufacturers of microchips and DVD players, each of which has resulted in the entry of a permanent injunction.

 Negotiated a favorable settlement in a long-standing dispute between the County and a property owner in which the homeowner alleged constitutional violations arising from the County’s building permit process.

 With David Codell and Alison MacKenzie, represented the mother of twins pro bono in opposing a petition for certiorari to the United States Supreme Court brought by a sperm donor who sought parental rights.

 With Michael Leslie and a coalition of defendants, successfully demurred to an action brought under California’s Proposition 65, alleging environmental releases and failure to warn regarding contamination at an old landfill site.

 Obtained a dismissal with prejudice on demurrer in an environmental action alleging contamination by long-abandoned pipelines.
